  • Return Policy: Consumer Protection Regulations (Transaction Cancellation), 5771-2010 By virtue of my authority under Section 14F and 37 of the Consumer Protection Law, 5741-1981 (hereinafter – the Law), in consultation with the Minister of Communications, the Minister of Tourism, the Minister of Transportation, the Minister of Health, the Minister of Education, the Minister of Science, the Minister of Culture and Sports and the Minister of Finance, in consultation with the Commissioner and with the approval of the Knesset's Economics Committee, I hereby enact these regulations: Definitions 1. In these regulations – “original packaging” – an object and any material used by the manufacturer or importer, as a wrapper for a product that he manufactured or imported and that does not constitute an integral part of the product and is not essential for the use of the product; “cancellation fees” – as defined in Section 14E(d) of the Law; “goods” – goods for which the price paid exceeds 50 new shekels. Cancellation of a transaction 2. A consumer may cancel an agreement in accordance with paragraphs (1) to (7) provided that cancellation of an agreement for the purchase of goods shall be on the condition that the consumer returns them to the trader and the goods are not damaged and have not been used by the purchasing consumer; the return of the goods in the original packaging shall constitute sufficient evidence of non-use – (1) for the purchase of goods or types of goods as stated in items 1 to 6 and 23 of the Appendix – within 14 days from the date of receipt of the goods; with regard to items 1 to 3, 6 and 23 of the Appendix, the opening of the original packaging in itself shall not be considered use or damage to the goods, unless proven otherwise; connecting the goods to electricity, gas or water shall be considered use of the goods for this purpose; (2) For the purchase of goods or types of goods as stated in item 7 of the Schedule – from the date of purchase until the end of two days thereafter that are not rest days, provided that the price tag on the goods, if any, has not been removed; (3) For the purchase of a service as stated in items 8 and 9 of the Schedule – within 14 days from the date of making the agreement, provided that the cancellation is made at least 14 days that are not rest days, prior to the date of commencement of the service; (4) For the purchase of a service as stated in items 10 to 19 of the Schedule – within 14 days from the date of making the transaction or from the date of delivery of a written contract or written document as stated in section 13C(c) of the Law, whichever is later, whether or not the provision of the service has commenced and even if the transaction is for a fixed period; (5) For the purchase of goods and services as stated in item 20 of the Appendix – for the purchase of goods, within 14 days from the date of receipt of the goods and for the purchase of a service, within 14 days from the date of making the transaction or from the date of delivery of a written contract or written document as stated in section 13C(c) of the Law, whichever is later, whether or not the provision of the service has commenced and even if the transaction is for a fixed period, however, in a transaction that is not a continuing transaction as defined in section 13C of the Law, within 14 days from the date of making the transaction and up to two days, which are not rest days, prior to the date of commencement of the service; (6) For the purchase of goods as stated in item 21 – within 14 days from the date of making the transaction, provided that it has not yet been registered in the consumer's name according to the Traffic Ordinance [New Version] (hereinafter – the Traffic Ordinance); (7) For the purchase of goods as stated in item 22 – from the date of purchase until the end of two days following that which are not rest days.
